More than 200,000 people are hospitalized for flu-related complications. There is a large debate about the number of deaths cause by the flu from 1976 to 2006 but it could be as high as 49,000 people. The number has decreased significantly over the years of how many people die from the flu since 1976. Vaccination have aided in this process. However, vaccinations and some drugs can still prove to be harmful. The US Food and Drug Admininstration‘s website indicates that a drug recall are categorized by Class I, II, and III. Class I recalls are the most severe, they can involve life threatening side effects. There were over 30 Class I recalls in 2012 from January to October. The medication that she received is sometimes used to induce miscarriage in unwanted pregnancies. Kidney Donor Dies After Surgery | Denver Medical Malpractice Attorney

Friday, June 22nd, 2012

According to CNN, a woman died after surgery to remove the kidney that she was donating to her brother, after a clip that the surgeon had used during the procedure slipped off, causing massive bleeding inside her abdomen. The clips that were used are designed to close off arteries that have been opened as part of surgical procedures, but they are contraindicated, meaning that they should not be used, for closing the renal artery after kidney donation surgery. The manufacturer sent letters to hospitals several years earlier stating that the clips should not be used for that purpose, but some doctors believe that the packaging that the clips come in should have a specific warning. In this case, the hospital in Lubbock, TX where this woman died was not using the clips at the time that they received the letter, and when they began using them several years later, the contents of the letter had been forgotten. It does not appear to be clear who is most responsible for the tragic death of this woman whose intention was to save her brother’s life, but it is clear that these types of cases can be extremely complicated.

Medical Malpractice Information | Colorado Medical Malpractice Lawyer

Thursday, December 1st, 2011

Whenever we go to the doctor’s office, we have an expectation in our minds that we will be cared for, and treated effectively by the doctor. Of course, people understand that doctors are human like the rest of us, and like everyone else, they make mistakes. Unfortunately, sometimes the mistakes that doctors make can cause tremendous harm to their patients. Nevertheless, it is important to remember that doctors are human like the rest of us. In rare cases, the mistake made by the doctor may be so large, and the harm caused to the patient may be so severe, that the patient, or his or her family if the mistake causes the patient’s death, may feel that they have no choice but to file a medical malpractice claim against the doctor.

Medical malpractice claims are very complicated and very expensive to pursue, and as a result, in order to bring action, your case will need to include several features in order to be viable. It is important that you contact a Colorado medical malpractice lawyer to help you through the process.  The first and most important feature involves what is called standard of care. While there is not a code of concrete standards of care for various medical procedures like there are standards of behavior for driving, there is a standard that medical professionals are expected to meet. In order to establish that the standard of care was not met, your attorney will hire an expert in the relevant medical field to comment on what the standard is, and how in your case the standard was not met. Next, the failure of the doctor to meet the standard must have caused significant injury. If failure to meet the standard of care causes minor injury or harm, then there may not be justification to bring legal action, given the cost and difficulty of medical malpractice claims. Finally, it must be possible to prove what he injury is; how it affects the patients life, and how it will continue to affect the physical and financial well-being of the patient into the future.

If you believe that you have been injured by the negligence of a medical professional, speak with an experienced Colorado medical malpractice lawyer as soon as possible. Medical malpractice cases are so complicated and so costly that the sooner after your injury you are able to speak with an attorney the better. William P. Godsman has the experience you need to understand the system, and can explain whether you have a claim or not. In many cases, even if you have been injured by a medical professional who failed to meet the standard of care, there may not be justification to file a claim. Will can help you understand your situation, and guide you as to whether you have a claim or not. For more information and a FREE CONSULTATION, contact Will Godsman at (303)455-6900.

Friday, November 4th, 2011

Brain injuries can occur in many different ways but no matter the cause, brain injuries are some of the most devastating and painful injuries one can endure. The NPR.org website recently reported a tragic story about a woman who suffered a traumatic brain injury due to a complication during surgery. Gweneviere Mann experienced a stroke due to an operation in 2008 to remove a brain tumor. The woman has suffered from short term memory loss ever since. It is now difficult for Mann to remember much details of her day and ultimately her life. Things that we all take for granted on a day to day basis such as today’s date and remembering when to eat lunch, is a constant struggle that Mann now has to conquer. Tricks such as keeping note cards in her pockets reminding her about the events that she has completed throughout the day helps maintain stability throughout her daily life. Mann also participates in marathons with her boyfriend to encourage herself to remain upbeat and optimistic about what abilities she does still possess. Even though this is a frustrating and discouraging situation, Mann is determined to fight and persevere through her disability.

Denver Malpractice and Medical Errors: The High Cost of Medical Injuries – Denver Medical Malpractice Attorney

Saturday, April 30th, 2011

According to a recent healthcare report by a Denver-area researcher, medical errors and medical injuries cost Americans at least $17 billion during 2008, the latest year for which complete statistics are available. This represents almost 1% of the total $2.39 trillion total spent on healthcare during that same period. The conclusion: Medical malpractice leads to errors which result in costly medical injuries.

Among the most-common medical injuries are pressure ulcers caused by failing to move and turn bedridden patients, and post-laminectomy syndrome, which is chronic back pain that often follows poorly-performed back surgery. And, side effects from medication errors, and infections and complications from implants and grafts, were also alarmingly common, and very costly.

Researchers seek to quantify the exact cost of medical errors and injuries, in which patients are harmed by the negligence of doctors and other healthcare practitioners. Although Colorado hosts many fine hospitals and healthcare institutions, still, as in any profession there are a small-yet-dangerous minority who commit medical malpractice. At least one study conducted through the National Institutes of Health (NIH) showed that in Colorado, as in some other states, the number of medical errors far exceeds those accounted for by medical malpractice claims… In other words, much medical malpractice goes unpunished.

Luckily, a Denver medical malpractice attorney can help. Experienced Denver medical malpractice lawyer, William Godsman, can protect your rights, hold the responsible parties accountable, and win the financial relief and long-term help that you need. Call Denver medical malpractice attorney, William Godsman, at (303) 455-6900 today to schedule your free consultation.

Colorado Surgical Mistakes

Tuesday, October 19th, 2010

The Denver Post has reported on a recent study published by the Colorado Physician Insurance Company (COPIC) on surgical mistakes by Colorado doctors between 2002 and 2008. Of the 20,000 plus surgeries that took place during this time, the “study found that 25 surgeries were performed on the wrong patient and 107 operations on the wrong body part.” A quarter of these mistakes caused serious harm to the victims. The lead author of the report, Dr. Philip Stahel, admitted that the “numbers are pretty shocking” and added that they aren’t unique to Colorado. These kinds of surgical mistakes are happening globally.

Every day in Colorado surgical patients must choose to put their lives and well-being into the hands of their surgeon. These patients trust that their surgeons are competent and prepared. The unfortunate reality is that some surgeons are not prepared and/or simply make mistakes. Colorado patients who have been the victim of a surgical error may be able to file a medical malpractice lawsuit to receive financial compensation for their injuries, including medical expenses and lost wages. An experienced and skilled malpractice attorney can assist a patient with these legal options.

If you or someone you know has been injured due to the mistake of a Colorado surgeon, you need to speak to a Denver malpractice attorney about your legal options. William P. Godsman has years of experience working on malpractice cases in Colorado and he will put his experience to work for you. For a free review of your case, contact his office today at (303) 455-6900.
