Denver Malpractice and Medical Errors: The High Cost of Medical Injuries – Denver Medical Malpractice Attorney

April 30th, 2011

According to a recent healthcare report by a Denver-area researcher, medical errors and medical injuries cost Americans at least $17 billion during 2008, the latest year for which complete statistics are available. This represents almost 1% of the total $2.39 trillion total spent on healthcare during that same period. The conclusion: Medical malpractice leads to errors which result in costly medical injuries.

Among the most-common medical injuries are pressure ulcers caused by failing to move and turn bedridden patients, and post-laminectomy syndrome, which is chronic back pain that often follows poorly-performed back surgery. And, side effects from medication errors, and infections and complications from implants and grafts, were also alarmingly common, and very costly.

Researchers seek to quantify the exact cost of medical errors and injuries, in which patients are harmed by the negligence of doctors and other healthcare practitioners. Although Colorado hosts many fine hospitals and healthcare institutions, still, as in any profession there are a small-yet-dangerous minority who commit medical malpractice. At least one study conducted through the National Institutes of Health (NIH) showed that in Colorado, as in some other states, the number of medical errors far exceeds those accounted for by medical malpractice claims… In other words, much medical malpractice goes unpunished.

Luckily, a Denver medical malpractice attorney can help. Experienced Denver medical malpractice lawyer, William Godsman, can protect your rights, hold the responsible parties accountable, and win the financial relief and long-term help that you need. According to CBS in Denver, around 3:30 p.m. on Sunday, March 13th, a young boy was injured and taken to the hospital after a hit and run accident at the intersection of Federal and Evans in Denver, Colorado. Eye witnesses said that the elderly driver was trying to get through the intersection before the light turned red, when he struck the boy and continued on driving. Traffic was diverted in the area for about an hour while police investigated the situation, and the hit and run driver was later arrested around 5:00 p.m.

Hit and run accidents in Denver and throughout the State of Colorado can be tragic–especially to pedestrians. According to the NHTSA, in 2009 alone, over 4,000 pedestrians were killed and it was estimated that 59,000 were injured due to traffic crashes in the United States. Hit and run accidents occur for many reasons, including:

  • Driving Intoxicated
  • Fear
  • Driving with a suspended license

Colorado State Trooper Injured in Car Crash – Denver Car Accident Lawyer

February 11th, 2011

9 News is reporting that a trooper with the Colorado State Patrol has been taken to a local Denver hospital after an early morning crash on I-70. The crash took place early Friday morning near the Havana exit. The interstate was closed for a time while police investigated the incident. One person has been taken into custody but few other details have been released at this point. There was no mention of the officer’s condition.

According to the Colorado State (CSP), 290 people were killed in Colorado automobile accidents in 2008. In 46 of these fatalities, speed was determined to be a contributing factor. It is imperative that all drivers obey speed limits and safety signs while on Colorado road ways and to be on the lookout for Colorado emergency vehicles. Nederland Rollover Victim Identified – Denver Car Accident Lawyer

December 13th, 2010

7 News has reported that Daniel M. Riley, a 24-year-old from Nederland, was the victim of a fatal rollover accident in Boulder Canyon on Saturday night. Riley’s SUV was headed southbound on Highway 119 when it “veered off the right side of the road, struck the mountain side, bounced back onto the roadway and rolled over.” Riley, who was not wearing a seat belt at the time of the accident, was partially ejected from the vehicle and pronounced dead at the scene of the crash. The cause of the crash remains under investigation at this time.

According to the Colorado State Patrol (CSP), 1635 people were killed in automobile accidents in the state between 2006 and 2008. That number accounts for 545 fatalities a year during this 3 year span. Seat belts dramatically increase the chances of survival in any automobile accident. This is especially true for rollover accidents where the possibility of being ejected from a vehicle is high.

Colorado Surgical Mistakes – Denver Malpractice Attorney

October 19th, 2010

The Denver Post has reported on a recent study published by the Colorado Physician Insurance Company (COPIC) on surgical mistakes by Colorado doctors between 2002 and 2008. Of the 20,000 plus surgeries that took place during this time, the “study found that 25 surgeries were performed on the wrong patient and 107 operations on the wrong body part.” A quarter of these mistakes caused serious harm to the victims. The lead author of the report, Dr. Philip Stahel, admitted that the “numbers are pretty shocking” and added that they aren’t unique to Colorado. These kinds of surgical mistakes are happening globally.

Every day in Colorado surgical patients must choose to put their lives and well-being into the hands of their surgeon. These patients trust that their surgeons are competent and prepared. The unfortunate reality is that some surgeons are not prepared and/or simply make mistakes. Colorado patients who have been the victim of a surgical error may be able to file a medical malpractice lawsuit to receive financial compensation for their injuries, including medical expenses and lost wages. An experienced and skilled malpractice attorney can assist a patient with these legal options.

If you or someone you know has been injured due to the mistake of a Colorado surgeon, you need to speak to a Denver malpractice attorney about your legal options. William P. Godsman has years of experience working on malpractice cases in Colorado and he will put his experience to work for you. For a free review of your case, contact his office today at (303) 455-6900.

Woman Evicted After Son Dies – Denver Premises Liability Attorney

October 1st, 2010

A single mother from Colorado Springs has been evicted from her Terry Ragan owned apartment for being behind on her rent roughly five weeks after her 15-month-old son slipped through a third story railing there and died. According to the Gazette, Adrianna Spedilari was ordered to vacate the Ceder Crest Apartments by September 8 after she failed to pay Septembers rent. Spedilari paid back the rent for September plus late fees on September 17th and agreed to vacate the apartment by the end of the month. On Monday, the attorney representing her and her child’s father, Christopher Perez, filed a motion that the eviction action be dismissed and replaced with a lawsuit against the apartment owner. The lawsuit claims that the third floor railings were spaced 8 inches apart creating a hazard for small children. The lawsuit claims that the apartment owner failed to correct or warn tenants and visitors of the problem. On July 30th, Spedilari was doing laundry on the third floor while a friend watched her son. Her son had squeezed through the railings and fell about 20 feet to the ground below. The boy died at the hospital.

Premises liability is a term used to describe the legal responsibility that a landowner and occupiers of a property have for injuries and accidents that occurred on that property. When determining liability reasonable effort on the behalf of the owner will be examined by answering some of these questions; have obstacles and hazards been cleaned up in a reasonable manner, or have guests been adequately warned that a hazard exists? If you have reason to believe the negligence of a property owner has contributed to an injury you’ve sustained, then speaking to a premises liability lawyer should be a priority. Premises liabilities cases will often allow damages based on pain and suffering, lost wages and medical expenses. Further premises liability may also compensate the surviving family members in the event of death as a result of qualifying injuries.

A Colorado Springs man who injured a police officer while driving drunk has been sentenced to four years in prison. 9News is reporting that 27-year-old Raymond Laracuente was sentenced Wednesday after pleading guilty to vehicular assault for injuring an officer whose specialty is DUI enforcement. The officer survived the wreck which catapulted him 45 feet off his motorcycle. Laracuente’s blood-alcohol content was measured at .112 after the crash, and he had a prior conviction for driving drunk.

In Colorado, DUI and impaired offenses are misdemeanors; injury-related DUI offenses are class 4 felonies. According to Alcoholalert.Com, between 2000 and 2008 there were 5,703 total traffic fatalities in the state of Colorado with 2,267 of those fatalities being alcohol related..

As we move through our lives we expect those around us to act in a responsible manner. But from time to time the people and businesses we come in contact with make mistakes or take dangerous situations for granted. When that happens we may be left with injuries or damages through no fault of our own. A personal injury case is a case that stems from the negligence of another. It may be an auto accident case. It might be the result of a slip and fall on ice or a busted-up walkway. It may be from a dog bite or an injury from a defective building or product. Whatever the case might be, when another person’s negligence causes us harm we could be legally entitled to recover for our damages. If you are concerned that you have suffered an unnecessary injury or impairment due to the negligence of another, contact Denver personal injury lawyer William P. Godsman today. He can provide a free case consultation and discuss with you your legal options for recovery. Call (303) 455-6900.

Johnstown Man Dies in Single-Car Crash – Denver Personal Injury Attorney

September 23rd, 2010

The Greely Tribune has reported that 39-year-old, Charles Bourland of Johnstown, died Tuesday from injuries sustained in a single-car crash in Greely. The accident occurred near the intersection of 10th Street and 71st Avenue around 10 a.m. The crash “happened just a block from the fire station on 10th Street,” but Bourland was pronounced dead at the scene. Bourland’s car hit a tree at a high rate of speed. Investigators did not say if he was wearing a seat belt at the time of the crash.

The fatality was the 25 traffic related death this year in Weld County, which is a decrease in the number of deaths through the same period last year. According to an AP story posted early this year, the number of fatalities due to car accidents has been in decline across the state of Colorado since 2002. In 2002, 743 people were killed in traffic accidents. That number dropped to 464 in 2009.

Even though the number of fatalities is in the decline in the state, the sad fact is that many people still lose their lives in traffic accidents. Will Godsman has years of experience working with victims of automobile accidents and he will put his experience to work for you.
